1. Description of Service

ThriveOS provides digital personal development utility tools, specifically habit trackers, goal-setting frameworks, and productivity analytics designed to help users track their own progress and organize their daily routines.

2. No Medical or Professional Advice

Important: The content and tools provided through ThriveOS are strictly for informational, self-tracking, and productivity purposes only. They are not intended to be, nor should they be construed as, professional medical advice, diagnosis, treatment, or health coaching.

Not a Medical Service: ThriveOS is a software utility for tracking user-generated goals. We do not offer medical advice, weight loss advice, muscle building advice, or psychological counseling.

Consult Professionals: Always seek the advice of your physician, psychologist, or other qualified health provider with any questions you may have regarding a medical condition, mental health concern, or lifestyle change.

No Reliance: Never disregard professional medical advice or delay in seeking it because of tools or information found on ThriveOS.

3. Accounts and Registration

To access certain features of the Service, you may be required to register for an account. You agree to:

• Provide accurate, current, and complete information during the registration process.
• Maintain the security of your password and accept all risks of unauthorized access to your account.
• Notify us immediately if you discover or suspect any security breaches related to the Service.

You must be at least 13 years of age (or the minimum age of digital consent in your country) to use this Service.

4. Subscriptions and Payments

Some parts of the Service are billed on a subscription basis ("Subscription(s)").

• Billing: You will be billed in advance on a recurring and periodic basis (such as monthly or annually), depending on the type of subscription plan you select.
• Payment Processors: We use third-party Merchant of Record services (such as Paddle) and App Store billing systems (Apple App Store and Google Play Store) to handle secure payments. We do not store your credit card information on our servers. By using Paddle, you agree to comply with their terms of service and acknowledge that Paddle acts as the Merchant of Record for web-based transactions.
• Auto-Renewal: Your Subscription will automatically renew at the end of each billing cycle unless you cancel it through your account settings or the respective App Store settings prior to the renewal date.
• Price Changes: ThriveOS reserves the right to modify subscription fees. Any price changes will be communicated to you in advance and will take effect at the start of the next subscription period.

5. Refund Policy

• General Policy: Except when required by law, paid Subscription fees are non-refundable. Certain refund requests for Subscriptions may be considered by ThriveOS on a case-by-case basis and granted at the sole discretion of ThriveOS.
• EU/UK Customers: By purchasing digital content from ThriveOS, you acknowledge and agree that the content is available for immediate use and that you waive your statutory right of withdrawal/cancellation once the download or access to the content has started.
• App Store Purchases: Refunds for subscriptions purchased via the Apple App Store or Google Play Store are handled exclusively by those platforms and are subject to their respective refund policies. We cannot issue refunds for purchases made through mobile app stores.

6. Intellectual Property

The Service and its original content (excluding Content provided by users), features, and functionality are and will remain the exclusive property of ThriveOS and its licensors. The Service is protected by copyright, trademark, and other laws of both the United Arab Emirates and foreign countries.

7. User Content

Our Service allows you to input data, text, and other materials ("User Content"). You retain all rights to any User Content you submit, post, or display on or through the Service. By using the Service, you grant us the right to store and process this data solely for the purpose of providing the Service to you. We do not sell your personal habit data to third parties.

8. Prohibited Activities

You agree not to engage in any of the following prohibited activities:

• Reverse engineering, decompiling, or disassembling any aspect of the Service.
• Using the Service to harass, abuse, or harm another person.
• Using the Service for any illegal or unauthorized purpose.
• Attempting to bypass any measures of the Service designed to prevent or restrict access.

9. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

10. Limitation of Liability

In no event shall ThriveOS, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation:

• Loss of profits, data, use, or goodwill;
• Other intangible losses;
• Resulting from:
• Your access to or use of or inability to access or use the Service;
• Any conduct or content of any third party on the Service;
• Any content obtained from the Service; and
• Unauthorized access, use, or alteration of your transmissions or content.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of Dubai, United Arab Emirates, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

12. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
